Welcome to EBSB Solutions (“EBSB Solutions,” “we,” “us,” or “our”). These Terms and Conditions govern your use of our website and your purchase of services, materials, and construction-related work from EBSB Solutions.

By requesting a quote, approving an estimate, purchasing materials or services, scheduling a project, or otherwise engaging EBSB Solutions, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

1. Services

EBSB Solutions provides building, construction, renovation, flooring, drywall, repair, installation, and related property improvement services.

The exact services provided for a project will be described in the applicable estimate, proposal, invoice, work order, construction agreement, or change order.

EBSB Solutions reserves the right to decline work that is unsafe, outside our capabilities, requires licensing or permitting beyond the scope of the agreed work, or cannot reasonably be completed under the requested conditions.

2. Estimates and Quotes

Estimates and quotes are based on the information available to EBSB Solutions at the time they are prepared.

Unless otherwise stated in writing, estimates are not guaranteed final project costs.

Additional costs may apply when previously unknown conditions are discovered, including concealed damage, structural issues, water damage, mold, code-related requirements, electrical or plumbing issues, unsuitable surfaces, or other conditions that could not reasonably be identified during the initial evaluation.

Quotes may have an expiration date. After the expiration date, pricing may be subject to change due to labor, material, supplier, fuel, or other cost increases.

3. Scope of Work

Only work specifically included in the approved scope of work is included in the quoted price.

Work outside the agreed scope may require a written change order and additional payment.

EBSB Solutions is not responsible for work performed by other contractors, homeowners, tenants, or third parties unless specifically agreed to in writing.

4. Change Orders

Changes requested by the customer after approval of the original scope may result in additional labor, materials, equipment, disposal, delivery, or scheduling costs.

Change orders should be approved in writing before additional work is performed whenever reasonably possible.

A change in materials, design, layout, color, product selection, or project requirements may affect both the price and completion schedule.

5. Materials

Materials may be purchased by EBSB Solutions on behalf of the customer when included in the project agreement.

Product availability, manufacturer delays, shipping delays, discontinued products, shortages, and supplier issues may affect project scheduling.

When a specific product is unavailable, EBSB Solutions may recommend a comparable substitute for customer approval.

Customers are responsible for providing accurate product selections, colors, measurements, and specifications when they are responsible for selecting materials.

6. Material Delivery

When applicable, EBSB Solutions may arrange for materials to be delivered to the job site before the scheduled project date.

Delivery dates may change due to supplier availability, weather, transportation delays, or circumstances outside our control.

7. Payment

Payment terms will be stated on the applicable estimate, invoice, construction agreement, or other project documentation.

Deposits or progress payments may be required before materials are purchased or work begins.

Unless otherwise agreed in writing, the customer is responsible for paying all approved charges associated with the project.

Failure to make required payments may result in delayed work, suspension of services, cancellation of the project, or collection of amounts owed.

8. Late or Non-Payment

EBSB Solutions reserves the right to suspend work when an account becomes past due.

The customer may be responsible for reasonable costs associated with collecting unpaid amounts, to the extent permitted by applicable law.

9. Scheduling

Project start dates and completion dates are estimates unless specifically guaranteed in a signed written agreement.

Schedules may be affected by weather, material availability, supplier delays, inspections, permits, site conditions, customer-requested changes, subcontractors, emergencies, or circumstances beyond EBSB Solutions' reasonable control.

10. Customer Responsibilities

The customer is responsible for:

- Providing reasonable access to the property.
- Removing personal belongings from work areas when requested.
- Providing access to necessary utilities when required.
- Informing EBSB Solutions of known property conditions that may affect the work.
- Making timely decisions regarding materials, colors, finishes, and design selections.
- Keeping children, pets, and unauthorized individuals away from active work areas.
- Making required payments according to the agreed payment schedule.

EBSB Solutions is not responsible for delays caused by the customer's failure to meet these responsibilities.

11. Existing Conditions

Construction and renovation work may reveal conditions that were not visible or reasonably discoverable before work began.

Examples include hidden water damage, structural damage, mold, rot, damaged subflooring, inadequate framing, outdated materials, code issues, or concealed plumbing and electrical conditions.

Additional work required because of such conditions may be treated as extra work and may require a change order.

12. Property Protection

EBSB Solutions will take reasonable measures to protect the work area.

However, construction and renovation activities may produce dust, noise, vibration, debris, odors, or other temporary conditions.

Customers should remove or protect valuables, fragile items, electronics, artwork, and personal belongings from areas affected by construction.

EBSB Solutions is not responsible for damage to items that were not properly removed or protected when the customer was responsible for doing so.

13. Permits and Inspections

When permits or inspections are required, responsibility for obtaining them will be identified in the applicable project agreement.

Customers should not assume that a permit or inspection is included unless it is specifically stated in writing.

14. Warranty

Any workmanship warranty provided by EBSB Solutions will be described in the applicable project agreement, estimate, invoice, or warranty documentation.

Manufacturer warranties for products and materials are separate from any workmanship warranty provided by EBSB Solutions.

Warranty coverage may not apply to damage caused by misuse, neglect, accidents, normal wear and tear, improper maintenance, unauthorized alterations, water intrusion, structural movement, or work performed by others.

15. Cancellations

Cancellation terms will be governed by the applicable signed agreement and applicable Ohio law.

If a customer cancels a project after materials have been purchased, special-order products have been ordered, labor has been scheduled, or work has begun, the customer may be responsible for costs already incurred, subject to applicable law and the terms of the project agreement.

16. Returns and Special-Order Materials

Material returns are subject to the manufacturer's or supplier's return policy.

Special-order, custom, opened, installed, or non-returnable materials may not be eligible for return.

Any applicable restocking, shipping, delivery, or cancellation fees may be the customer's responsibility when permitted by the applicable agreement and law.

17. Photos and Project Documentation

EBSB Solutions may photograph completed or in-progress work for project documentation, quality control, estimating, and recordkeeping.

Use of project photographs for advertising, social media, website content, or promotional purposes will be handled in accordance with any applicable customer agreement or permission.

18. Website Information

Information provided on the EBSB Solutions website is intended for general informational purposes.

Descriptions, photographs, examples, pricing information, service availability, and other website content may change without notice.

Website content does not replace the terms of a signed construction agreement, proposal, estimate, invoice, or change order.

19. Third-Party Products and Services

EBSB Solutions may use products, materials, suppliers, manufacturers, subcontractors, or other third-party services in connection with a project.

EBSB Solutions is not responsible for delays or failures caused by third parties that are outside our reasonable control.

Manufacturer warranties remain subject to the manufacturer's own terms and conditions.

20. Limitation of Liability

To the fullest extent permitted by applicable law, EBSB Solutions will not be responsible for indirect, incidental, special, or consequential damages arising from delays, interruptions, or circumstances outside our reasonable control.

Nothing in these Terms and Conditions is intended to waive any rights or protections that cannot legally be waived under applicable law.

21. Force Majeure

EBSB Solutions will not be considered in breach of an agreement when performance is delayed or prevented by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, government actions, supply shortages, transportation disruptions, labor disruptions, emergencies, or other unforeseen events.

22. Website Use

You agree not to misuse the EBSB Solutions website, attempt to interfere with its operation, introduce malicious software, or use website content for unlawful purposes.

All website content, branding, logos, photographs, text, graphics, and other original materials belonging to EBSB Solutions may not be copied, reproduced, or used without permission, except as permitted by law.

23. Privacy

Use of personal information submitted through the website is subject to our Privacy Policy.

Customers should avoid submitting sensitive personal information through website forms unless specifically requested.

24. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable law requires otherwise.

25. Severability

If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

26. Changes to These Terms

EBSB Solutions may update these Terms and Conditions from time to time.

The updated version will be posted on this website with a revised effective date.

27. Entire Agreement

For a specific construction project, the signed construction agreement, proposal, estimate, invoice, change order, warranty documentation, and other project-specific documents may contain terms that control over general website Terms and Conditions.

Customers should review all project documents carefully before approving work.
